Did you report the incident to the police? If not, you need to! It would be hard for him to get custody or unsupervised visitation if he's in PRISON!

No I didn't report it for fear he may hurt me or our child. His mom worked for the state and has "CLOUT" and gets him out of lots of trouble ALL THE TIME. She has been "bailing him out for years" using her "CLOUT" he says. I want my child to grow up without fear or perenoia *sp*. Our child will not be safe with him.

Mom's connections will only help her to a certain point. I doubt she has enough clout to get him out of attempted manslaughter, reckless endangerment, unlawful firing of a gun and possesion of an illegal firearm charges.

It's possible that some people would not believe you. The fact that you are reporting this riight before you go to court for custody. When you bring it up in Family court he may even lie about it. It would be good to have a third party confirm as much as your story as possible. Does anyone else know that he owns the gun? Did anyone hear the shots? Did anyone see him on the balcony? Did anyone actually see him shooting?

It would be great if you could find other people to testify, but if you can't, it doesn't mean that the judge won't believe you. The judge will determine which one of you is more credible and he could very well take your word on the matter. His criminal record is probably going to hurt his credibility. Even if mom covered his a$$ there would still be arrest records and reports.

I moved away from where he lives currently. I don't believe anyone saw him doing this off the balcony but I do know lots of people heard the shots. I just want to go about this in the most painless way for my child as possible. I still want my child to know who "Daddy" is but in a sense I don't because of the violent behaviors, foul language, kicking down bedroom doors to torment me. Im happier now that I have left but I really would like to know if I did take this to court by me not having proof of the shooting but having proof by friends that he has a violent temper and he threatened me do I have a case. He has absolutely NOTHING ON ME because I keep myself to myself. I mean he even went as far as to torture my cat. He wanted to flush her out from up under the kitchen sink we were having fixed one late evening and instead of him using water... *which is what cats are scared of* the IDIOT USED PINESOL!!!!! My cat was sick for a week. I bathed her but her voice has never been the same. He won't give me my cat, he won't pay child support for our child. I just want to put him UP UNDER THE JAIL!!! But his sweet mother... I feel for her.

Like I said before, the judge may or may not believe you. The witnesses strengthen your case and judges are usually pretty good at figuring out which person is telling the truth. After all, judges do judge. If you REALLY believe he could or would hurt the baby, you need to be more concerned about protecting the child then hurting his mother. Even if dad is not a part of the child's life, that doesn't mean you have to shut out grandma.

So, he just started this violent behavior once you became pregnant? I ask because you chose to lay down with him and you chose to have a child with him. If you have nothing on record about his violent behavior, you cannot keep the child away from him.
