Hi, I live in Los Angeles, Ca and I received a DUI (I believe in 2001 or 2002) and was charged with whatever one is charged with for a DUI. My lawyer told me that by pleading guilty and not committing any offenses for 4 years the charge would be expunged from my record. I have since never received a violation of any sort, completed all my requirements, paid all the fees and received all the court paperwork to the effect that I paid my debt to society and so forth. I believe I have the paperwork somewhere if need be. I applied for a corporate job about 4 years ago and they did a background check with criminal backgrounds on Illinois (my home town) and California and I was pleased to not see the DUI on there.
I am applying for a new job that I desperately need and feel I will easily get and I would very much like to put down that I have NOT been arrested and charged with a DUI if I can (I have read that the records are erased after being expunged, but still exist somewhere- and that if the records are erased -and you write "no" on the application- you are not liable for the offense by the prospective employee, BUT you are liable for lying about it.
My question is this: How can I reputedly find out if I still carry that offense on my record, and generally is it advisable legally to say "no" on the application IF the prior offense from 2001-2002 does not show on my record.
