In New Jersey - When i divorced my abusive ex husband i wanted as little further contact with him as possible. He was working under the table and could not prove enough income to refinance our home in his name alone, i allowed him to leave my name on the mortgage and gave him a period of 3 yrs to refinance on his own ( i have a signed notarized document that was included w/our divorce agreement). 3yrs is almost up and the house has increased in value. If he can't refinance and has to sell can i get any money out of the "profit."

My response:

Did you sign a "Quit Claim Deed" ? If you did, then the answer is no. Obviously, the obverse is also true.
