Its been a while since I have been on here. It is good to see some of the same people still helping others with their advice
Briefly...I am from Indiana. I have been going thru my divorce for over 2 years now. I am pro-se and in the beginning my concern was for my son and getting supervised visitation...which I was sucessful at. The only hold up now is for him to sign and send his motion to skip the final hearing to the court. I have not brought mine to the court house cause I am waiting on him. We were married nov 98 I left 7 months later divorve filed june of 99 but I was pregnant. Son born Nov 99. He is re-married and living in WI. My question is this. He owns a house here in Indy that is now vacant. Of course there is a mortgage on it and he has very little equity if any. He has only paid $100 in child support. I would like to move into the house and take over payments. I have offered to his attorney that he could turn it over to me and I would sign off his back child support but i doubt if he would agree because that would be helping me out. is there a chance that I could go ahead and ask for a final hearing and get the house. I am not sure as to the status...like if he is keeping up on mortgage payments so it might not even be worth it. I dont have money for an attorney and am in the middle of being evicted because of some very bad luck I fell behind and cant catch up. I have 4 kids only 1 his. I just want to know what the chances would be. would they lean in my favor or his. he own the house before we were married. Thank you so much.

I realize you can not gaurantee an outcome. I just wanted to know if anyone thought there was a good chance of getting the house. thanks

No, we can't tell you whether this idea will work or not.

My answer is this: You can always ask.

Whether you get it or not will be up to the court and possibly the bank, depending on whether the home is in foreclosure proceedings.
