I have won a case in California Small Claims Court for $1,900 against an individual who has not repaid a personal loan. In thirty days I will be entitled to obtain a Writ of Execution that allows the sheriff to collect the judgment. The defendant is an employee and is paid twice monthly, with a gross salary of $5,000.
My question regards how a wage garnishment is handled by the sheriff?
Does the sheriff meet with the employer/defendant in order to reach some payment arrangement or does the sheriff attempt to collect the entire amount with one visit?
I also know the defendant’s bank account information. Should I also I attach a writ of execution to the bank account?
This is a case in the State of California.
