A Writ of Execution has been filed against me over a debt which I have no intention of paying, because the debt was a result of fraud. I lost the case trying to defend myself (no money for an attorney), but thats another story entirely. Im going through a tough time right now and I moved back in with my mother last year. I own no property at all, so I am not worried about them taking any of my property. My concern is, I do not want a constable coming to my mothers home and upsetting my mother. How can I keep the constable away from my mothers home, other than the obvious way of paying the debt which btw is $9000.

Simple answer.... you can't. The constable's visit is court ordered and he/she has no choice but to attempt to execute the writ. In fact, if they don't, the judgment creditor could hold the constables office liable!!

Your only option to try to stop the legal, valid enforcement process is to contact the creditor and negotiate a settlement... and pay it.

This sounds a lot like the same problem I ask about that no one bothered to answer, Except I am willing to pay the debt but don't know what forms/actions I should be looking for to stop the execution against goods. Sorry for jumping your post for my problem!
