I am writing because I would like to know what the formal legal procedures are for garnishing wages in Hillsborough County, state of New Hampshire. I won a judgment over two years ago and just recently learned of the defendant's place of employment. I wish to garnish his wages. I wrote a letter to the court requesting an order to garnish the defendant's wages and was told I had to file formal wage garnishment procedures. Am I supposed to formally ask the judge for a Writ of Garnishment against the defendant? I am not sure what the formal procedure is and where I can go to learn more. What exactly do I do, or write to the judge to begin garnishing the defendant's wages immediately? Any help is appreciated!

There usually is a form to fill out at the courthouse. I suggest that you call the court and request the form be sent to you since you are out of state (from your posting) and see if they can't send you the proper form in order to garnish wages. Then you will have to go thru the procedures that court has made for issuing the garnishment.

Sorry I can't be of more help.
