Written 5 yr. warranty.....breach of warranty

We purchased a brand new manufactured home from a company about 2 1/2 yrs. ago. There had been a class action lawsuit against the masonite hardboard siding going on for 5 yrs. The manufacturer of our home did not tell us at time of purchase (no disclaimer) or if we would have know we would have chosen different siding. Right now our exterior siding is buckeling, warping and looks terrible. We did as the manufacturer told us to do and went thru the class action lawsuit but they will only give us $267.00 to fix the problem. Our estimates for new siding are between $6000-$8000. Shouldn't the manufacturer WHO GAVE US THE WRITTEN 5 YR. WARRANTY AGAINST EXTERIOR SIDING honor their warranty. They won't!!! The supplier of their exterior siding (masonite) did not give us the warranty the manufacturer (company) did. Who should honor the warranty?

My response:

In order to assist you, we'd need to see the terms and conditions of the Class Action settlement. Then, we'd need to see all of the terms and conditions of the warranty. The easiest thing for you to do is to see an attorney. Bring all of your papers, including the results of the Class Action settlement, for review, potential representation and action. There may be the possibility the attorney will take this matter on a contingency.

The terms & conditions of the written 5 yr warranty states that the manufacturer (who we bought the house from) will cover damage to exterior walls (siding). We were NOT told about the class action lawsuit at time of purchase nor were we given a revision to the warranty stating that if there is damage to the exterior siding they (the manufacturer) will not cover it. The Class Action Lawsuit did not give us a warranty; they came out and determined the damage to be $267.00; that is a slap in the face....the damage (we have had estimates) is between $6000-8000 to replace. The manufacturer needs to honor their warranty!

Is anybody aware of any PI cases involving hardboard siding (Masonite, LP, etc.) with respect to toxic mold growth?
