the ticket does not have my correct date of birth. It is listed as 10 days after the traffic infraction occurred. is this a tech to get out of ticket with? if so can you please cite reference of nys traffic law (v&T)?

Generally only an incorrect name, d/l number or place of violation is considered a valid reason to have a citation dismissed on a technicality. A birth date has no bearing on the validity of the citation.
