wrong paternity/welfare benefits

I cheated on my boyfriend about 8 years ago. It was a one night stand and I barely remember what the man looked like. A little over a month later I found out I was pregnant. I did not tell my boyfriend I had cheated because I felt horrible for cheating and for the fact that I was pregnant. Anyway, I didn't have medical insurance to pay for the birth. I went on medicaid. When I filled out information regarding the absent parent I only told the welfare agency of the one night stand. I did not tell them of the boyfriend. Anyway, we stayed together and dated on and off during the pregnancy and after. I continued to collect welfare. After the baby was born, I did not put anyone's name on the birth certificate. My daughter was almost two years old before I could tell who the father was. My boyfriend all this time thought he was the father and luckily he is the father. The child looks almost identical to him.

We broke up permanently three years ago. I have filed for child support about a month ago. He just received a letter from the Friend of the Court regarding paternity status and the one night stand's name was on the papers. Of course I had to tell him the truth. My question is, what is going to happen with this case? Because I did not list my child's father's name on the list of potential fathers, will he have to pay back the medical portion of the welfare? I don't know if what I did 8 years ago was wrong. I was scared to tell him and I did not want him to find out so I guess you can say I lied on the paperwork. What now?

Ok, I am totally confused. How do you mean he received a letter stating the one night stands name? Has ex b/f been tested for paternity? You had to tell someone the name of the father in order to file against him for support. These agencies share their info. Any time a mother/father files for support against another person they check to see if there were any type of Title IV benefits paid..(welfare and medicaid) if there were then they check the info given at the time those benefits are applied for. You may be looking at some serious penalties if the state finds out you were with the boyfriend and failed to name him as a potential father, not only that but your credibility is now shot. You didnt list this man as a potential father then file against him for support? It wont take a judge long to determine that you were trying to protect the father at the time and therefore you may end up having to repay the state for all benefits received.

I am in Ohio and when I went to my paterity hearing, we let the courts know that the father was there throughout the birth and helped to raise our twins even though we were not together. The court ordered no pay back of welfare benefits because he was a active parent, But he was ordered to pay support from that day forward. hope that helps you alittle
