Hello,
I was ticketed yesterday for being within 25' of an intersection in the Town of Dover, NJ. I think the law itself is a little ridiculous but I'm not going to complain about that because in the end it is still the law, I just got unlucky(I wasn't even in the crosswalk)
My problem is that when I went onto njmcdirect.com to check my ticket. The price was $54 which I thought was pretty steep for the offense, and I'm an out of state full time student so I don't have any money to spare really so I wanted to check everything over before I paid.
I looked up statutes for Morris county NJ and found a list for parking offenses. The one written on my ticket under "Statute No." is 39:4-138A and that is also the one that appears on the njmdirect.com site where I can pay my ticket. (it says 39:4-138A - Improper Parking Within Intersection). But on my ticket under "Other Traffic/Parking Offense(describe)" it says 25 Feet of Intersection. When Looking at the list of statutes on the Morris County page it lists 25' of intersection as a 39:4-138D, and 39:4-138A is parking within an intersection. I don't really know much about how fines work but I would believe that parking within an intersection and parking within 25' of an intersection would carry 2 different fines as one is much more dangerous and irresponsible than the other.
So the statute on written on my ticket didn't match the officers description of my offense. I called the Dover Joint Municipal Court and talked to a woman who didn't seem in a very good mood. Plus it was close to closing time so getting information and help was like blood from a stone. Basically she said something like the individual towns can overrule the county law(I'm not sure, it was all rushed and fast) Then she also said it makes a difference if it is Local Ordinance or State which brings me to my 2nd question. The "Ordinance/Code No." box was left blank on my ticket. Is that where it would say which it is? All she told me to look for was "L.O." at the bottom and I asked her to be more specific and she just repeated "the bottom". I could tell she didn't want to talk so I just thanked her and said goodbye.
I just really want to make sure that I am paying the correct fine. Even if I only save 5 or 10 bucks, thats money that I am going to be spending on groceries because that is all I have money for while I am at school, and I don't have much, haha.
Any information to the two questions would be a great help. I can't seem to find a list of statutes specific to Dover on the town of Dover's site.
