Wrongful Car Repossession

What is the name of your state (only U.S. law)? Maryland

Hello! My sister's car was repossessed on Oct 27, due to missed payments, yet she says she was on a payment plan to catch up on payments (she's been unemployed for two years). Anyway, there was no notice sent via mail, phone call or anything to alert her that the car would be repossessed. She finally recovered the car from the impound on November 4, for about $2000. Today, November 16, she just received a two certified letters from the lien holder, telling her the time and date that they had planned to repossess her car.... The letters were post-dated and certified on November 4, and the actual written letters were dated October 31. She also says that they have attached the impound costs and other late fees (the $2000 she already paid to retrieve the car) to the total car loan amount.

My question(s): Is this legal? What can be done? Should she report this lien holder to someone/someplace?:confused:

Yes, it is legal.

Those notices are timed to arrive post-repo. Why? Because if you knew it was coming, you could hide the asset.

And it perfectly legitmate that she bear the costs of the impound and other fees. She'd not have incurred them had she remained in compliance with the payment plan.
