wrongful death, injuries in car accident

my friend's husband was killed outright in a head-on collision when police were chasing a stolen car; her mother was injured, hospitalized & recovering when she developed pneumonia & died. My friend was hospitalized in a coma for 3 months & recovered with hand & leg permanent disabilities & can no longer work. The driver of the stolen car was a 33 yr old intoxicated woman who had had previous run-ins with the law, has no assets & is currently in prison. my friend is 60 yrs old & manages to live on social security disability & a small pension her husband left her. My question is, can't she sue the police who were chasing the felon who ran the red light & crashed head-on to my friend's car. It doesn't seem right that she should have to live without her husband, lost her mother & also now can't even work to support herself.. This happened in Denver, CO 3 years ago..don't know what the statute of limitations are for this. Any thoughts??

My response:

It is undoubtedly too late for your friend to make any claims against the governmental entity. Usually, there is a very small window of time within which to make a claim. But, even if she could, governmental entities and agencies usually have "immunity" from such liability. She had 180 days after the accident to file a "Government Claim for Damages", and once denied, 2 years within which to file a lawsuit.

I hope that she made a claim for her "Victim of Violent Crime" funds. Again, there is a short window of time within which to make such a claim; but, if she didn't, it's highly likely that it is now too late.
