What is the name of your state (only U.S. law)? CA

My best friends son was accidently killed at the negligence of a US agency. Its actually kind of a big deal in this area. All sorts of attorneys were trying to get her to sign a retainer... she picked a reputable large firm for 50% and she pays fees if won. But the lead attorney only has negative things to say, is kind of a bully, never returns her calls.... it just doesnt feel like he is fighting, doesnt supena witnesses, but the case is moving forward and its scheduled to go to court - full steam ahead.

Her son was her only child and they were very close, when he died she had a nervous breakdown and had to go on disability, using credit cards to live and pay for her meds (suicidal) finally now - filing bankruptcy with roughly $30k debt.

She just recieved a notice from her own wrongful death attorney that he is seeking court approval to be hired the BK trustee to represent THEM against HER lawsuit and that THEY get 25% of any settlement in the wrongful death lawsuit? AND he is to get 50% of what he now collects for THEM as well?

Could this be some kind of misunderstanding? Is this common? Its like she is being represented and then prosecuted by the same man...???

That would be a good question for HER to ask her attorney.
She has called... but like I said.... he doesn't return her calls. Right now, he is on vacation... but when he gets back he still will not call her back unless he has some reason to talk to her. A lot of workd has been done on this case and it is getting closer to trial.

Perhaps she should call the State Bar Association?
