My response:
Since judgment has not occurred, I will assume, at this point, that you are correct.
When the initial lawsuit is complete, and the judge in that case determines that your company is without fault, you can file a new lawsuit to sue the Plaintiff for "Malicious Prosecution" to obtain your damages. Until the intial case is over, you can't do anything except to defend at this point in time. Keep records of what you have done in this lawsuit and the affects it has had on your business. You're going to need that information for your own lawsuit.
