What I would like to ask is if it is discrimination/wrongful termination with breach of contract if.
I have been told that there is no job available for me to return to in my companies American location after being overseas at Corp. headquarters for two years on an expatriate contract. Then I find out that the company has placed a Taiwan national in an equivalent position to what I have been told does not exist.
This company has released almost all senior level product managers and product managers as well as many others under the guise of down sizing during the past 12 months, but they have kept most of the Taiwan nationals which they have sent over from corporate headquarters who are there on work visas.
I am being returned to the US because the company claims it is too expensive to have expatriate employees, but they keep a large number of Taiwan nationals still working at the regional level as Expatriates while laying off those of local hire.
I have watched this company do this same thing at many of their regional offices world wide. They call it house cleaning. They release all of the senior level and high paid employees to reduce cost and then over a period of months proceed to hire on new entry level people to fill the old positions. Normally they replace the president of that regional first and use this change as the explanation for restructuring. If they need an immediate talent pool to hold them over during the transition. They bring people over from the home office until the new staff comes up to speed.
I also have a clause in my contract which calls for me to have 60 days to repatriate and find a position within the company after my return to the US operation. This clause has been ignored. My termination date was April 30th 2001 while still in Taiwan.
This just seems a wrong to me, but I do not know if there is anything I can do about it.
It is my belief that I have been the victim of this layoff do to my national origin and race. I also beleive that I have been subjected to a breach of contract by not having the opportunity to repatriate as called for by my contract.
My contract was in the state of California.
