I have worked for a company for 10years. Within the past year I started getting sick. I had to use what they call intermitted FLMA. I tried to fight my illness without having to use the FLMA but my manager would get me for attendence inbetween my FLMA.I was put on probabtion December 2005 right after moving to new department with new manager. I was doing alot better.My work production was 100%plus. But unknown to me each Director has their own attendence policy. My FLMA ended February 22, 2005 after 3months I was told that I had gone over the percentage. They also included saturdays. It took 2 weeks before I was told that I was terminated. I never spoke to HR or anyone higher. I was told by outside source I should seek legal council for my termination. 1)They should have a unisome attendence policy across the floor.I was within the guidelines for the policy I had known from previous years. I was never told of this different policy until it was to late.
I worked for the company for 10years and never had been written before. My production was usually 100 plus, I was on time from breaks/lunch and did not abuse company equipment. I was asked if i was given an exist review and I had not, no one had bother to talk to me. I really feel slighted, that I gave my time and respect to this company but once I fell ill. I feel I was kicked to the curb.

I was asked if i was given an exist review and I had not, no one had bother to talk to me. No laws require that employers perform exit interviews. When employers choose to do so, they're typically done with employees who resign, not employees who are fired.

If you exhausted all your FMLA leave time and continued to be absent, your employer was free to terminate your employment.

I hadn't exhausted all my FLMA. I did not renew it. I thought I was within the attendence guidelines until I was told I had gone over the percentage.
I really did not figure I had a case but it never hurts to ask. After all, we all can be replaced.
