Wrongful termination?

What is the name of your state (only U.S. law)? Nevada

I'm trying to help a friend of mine and thought this forum would be a great place to start.

She is a manger at a doughnut shop. Just a few days ago the health department came through. The store received a "B" Within 24hrs She was fired.(no prior problems what so ever)

Some of the Demerits given to the store were out of her control; some of which have been on record with the company for a long time needing to be fixed.

The store's reach in cooler has been defective since the day she started working there. She has put a few work orders to get it fix but nothing has come about.

There was no sanatizer in the store, due in part to the machine that dilutes the solution was also broken for quite some time. Work orders were also asked but again nothing came about.


The last point is the company policy is to terminate any mangers on duty who recieve anything lower than an "A" yet a manger at a different store recieved a "C" and kept his job.

Wrongful termination has a specific meaning under the law.

She was not fired because of her inclusion in a protected class (race, sex, national origin, age, etc) or in violation of public policy (she was not filing a grievance with the DOL, for example).

Therefore, her termination falls into the "unfair but not illegal" category.

Nothing you have posted suggests a wrongful termination.

A wrongful termination means that she was terminated for a reason prohibited by law, not that she was termed for something she didn't do (or something outside of her control); nor does it mean a termination in violation of company policy. Unless there is a specific law that would have otherwise prohibited the employer from terming her for the reason he did, it is not a wrongful termination.
