I'm new to this site and was trying to figure out how it works.

I was the secreatry/treasurer for our Homeowners' Association for over 4 years. I was recently voted back in for another term along with a group of new members of which a few disliked me for whatever reasons. I heard comments such as "the white woman thinks she runs the neighborhood" to mention only one. I am the ONLY white person on the entire board and feel I am being discriminated against.

My problem is that after four years of volunteering my time, I decided to resign. The stress was interferring with my real job not to mention my home life.

I feel the board members are retaliating because I "dumped" everything in their laps so to speak. They are accusing me of misuing HOA funds. It was agreed upon in one of our board meetings last year that in lieu of a salary I would buy gas for my car once a month for my time and errands ran for the HOA. Somehow that page of the minutes got misplaced and they are asking that I pay back the money that I spent for gas or there will be "legal ramifications". I have no one to back me so it's the 5 members against me.

I am not going to pay this back but wonder what grounds they have or if they have any case at all.

If there is no record found of the agreement made last year allowing you to use HOA funds, for gas reimbursement in lieu of salary as compensation for your time, I would contact the former HOA board members. You should have them write out statements, signed and notarized, verifying the agreement made. Present these signed statements to the current board.

It wouldn't hurt to have an accounting of all HOA funds used as reimbursement, and all of the corresponding gas receipts.

If the HOA board continues to accuse you of the misuse of funds, even with the evidence presented, contact an attorney.
