What is the name of your state (only U.S. law)? Texas

I recently ordered party supplies online. Upon receiving my package, I noticed a small bottle that says Xanax on it. I have yet to open it because I was scared that there could be something else in it that could injure me, i.e. anthrax scare. I called the company where I ordered this from and they said they would have someone call me about this. I received 2 calls. One where they apologized, another where they asked if the package had been tampered with maybe by UPS, which I told them it hadn't. What if a child had opened this package?? Can I file anything against them?

What exactly is it that you are trying to "file" against them and what are you hoping to get out of all this? Nothing happened. You found the drugs before anyone got to them, and you admit that the bottle remains unopened even now. There are no damages, you just found something that got shipped to you even though you never ordered it. If you are so concerned about it, ask the company to reimburse you for shipping it back, or give the bottle to the proper authorities to have them dispose of the drugs properly.

No harm, no foul. And NO lawsuit lottery jackpot for you!

But I suppose Xanax could be considered a "party supply" in some social circles. ;)

why would one even consider opening a bottle of drugs they received in such a situation.

as it stands, the shipping company is apparently denying responsibility for the bottle. Sounds like the police or the USPS would be the proper entity to contact.
