Some history: We've been this house for 18 years, and have had four different sets of neighbors during that time. Our houses are fairly close to each other (ca. 13-15 feet), and the neighbor's house has a chain link fence around the back yard.
Since the houses were so close, we were constantly in each others face during any backyard activity. No problems or anything, but at times you wish you could just enjoy the backyard without looking at the neighbors.
About three years ago, while the house next door was vacant, we erected some privacy fence panels adjacent to the chain link fence on our side to block the view between the back yards. So far, so good.
The current neighbors bought the house a couple of years ago, and we never really warmed up to each other. A couple of months ago, my wife and the male owner had a few words with each other over him driving partially through our front yard to park his vehicle. One thing has led to another (none of it good), and now the neighbors have erected a privacy fence for the length of property boundary.
Now this new fence is totally on their property and that's OK. What I have discovered through all this is that the partial fence we erected way before their arrival, is actually on their property (by several inches), and was used to attached panels of their new fence. They also replaced a pole at the end of the fence.
Now I don't really have a problem with this, but it is bugging my wife. She wants to confront the neighbors over this without admitting that we erected the fence. My take is that if we don't claim the fence, with it being on their property, I would think that they would feel they could do what they please with it. Of course, if we do claim the partial fence as ours, we could be asked to move it.
What are the options here?
