I was diagnosed 1 1/2 years ago w/tendonitis in my ankles due to overtraining.just recently i got tangled up in a cord @ work and tore my retinaculum in my right ankle(fyi-retinaculum is a tendon/ligament that wraps around ankle )this has just made my original condition that much worse.I feel i need to see a specialist b/c my pcp just has been giving me painkillers in increasing strength since my original diagnosis.can i submit the specialist's bills to my employer or should i submit them to my own insurance b/c the problem was already there although made much worse by work accident.my employer has already agreed to pick up the initial er visit on date of injury and the follow-up w/ my pcp.this is occurring in virginia

I would definitely file this as a workers comp claim. Yes you had the problems prior to the cord wrapping around your ankle, but it was aggravated by the incident.

It was explained to me by an attorney in this manner on my own injury.

If you have had surgery, say on your back.. and it is being treated and pain is controlled through treatment or you have not had any problems at all with it since recouperating from the surgery, and you get into a car accident which results in damage to the area already being treated and controlled. The insurance for the auto accident then becomes responsible for your future treatment because it has reinjured you.

The argument for the insurance carrier that paid for the original surgery would be, we treated the problem, has had no reoccurences and now after the car accident the patient does. So car insurance carrier is then responsible for the treatments.

Hope I made some sense out of this, lost my train of thought halfway through.
