Hospital worker doesn't want Covid vaccine.

It's clear at this point since the Texas case that the hospitals have the upper hand... for now.

Due to this emboldened stance the hospital my wife works for in NC gave their employees till October to get vaccinated or be terminated.

My wife texted this too me just now "..they brought up the vaccine at huddle and said that the hospital has contacted a lawyer and they are covered as far as any law suits and that if anyone tries the religious route, that it won't stand up if you have ever taken the flu shot or other vaccine. They also said if you don't resign, they will take discipline action against you and you can never work for them again."

This question is less to do with how she can keep her job and more to do with how the hospital can treat it's employees, who have not been vaccinated, during this phase?

Can the management bully them?

Obviously the hospital wants the standouts to quit instead of be fired.

what would you be on the lookout for that might cross the line for the hospital?

Despite your use of a question mark, this sentence is not a question. To the extent you were asking, "how can the hospital treat its employees," your question is hopelessly vague.

"Bully" is not a term that has any particular legal meaning (with the possible exception of some laws in some states relating to school situations). That being said, it certainly is possible that management can and legally may take certain actions that some persons might subjectively characterize as "bullying."

Not really sure what you're asking.

The management can keep unvaccinated employees away from the vulnerable population in the hospital and management can require masking, among other actions up to and including job termination.

Hospitals, like many other employers, are getting fed up with those who refuse to mask and who refuse to get vaccinated. These workers are making workplaces unsafe for everyone.

Your wife might want to start looking for another job now.

Is this a private hospital or a government owned/operated hospital? If it's government owned/operated, is it a county, state, or federal facility? Is your wife a member of union that has a collective bargaining agreement (CBA) with the hospital?

Hoping that a quit would make an employee ineligible for unemployment compensation. Which is not necessarily the case with "resign or be fired" threats, or other kinds of pressure.

Your wife is probably not going to be able to prevent losing this job one way or the other if she doesn't get vaccinated but she can at least try to protect her right to unemployment compensation. In Texas it's legal to record a conversation without the other person's knowledge. Might help document the situation.

Frankly, though, it's rather foolish not to get vaccinated, especially with the Delta strain preying on the unvaccinated.

The state is North Carolina, adjusterjack. Recording a conversation if you are a party to the conversation can be legal but could violate hospital policy. I don’t see that any recording is going to protect an unvaccinated employee when the employer mandates vaccines.

Thank you for your response, it was the most helpful one. You can record a conversation also in NC and we are looking at doing that up till she is forced out, just in case.
For the rest of you... the vaccine is not as safe as it appears. Do your own research, the victims are piling up. Good luck.

I agree that victims are piling up. They are overwhelmingly unvaccinated victims.

If your wife records conversations, she should make sure that recording devices and recording is permitted and that she is a part of any conversation recorded. Refer to the recording law in the link previously provided.

I think your wife should start looking for another job.
