PA's Disorderly Conduct statute requires a "public" inconvenience, annoyance, or alarm. OUr courts have routinely ruled that a police officer, in the performance of his duties, is not "the public". This means that a "victim" must exist, or else DC doesn't apply.

Not exactly. He can certainly testify to what he heard and saw. He cannot, barring some exceptions, testify as to what someone else said to him though.

And the entire premis of your defense if that you "KNOW" they did not see anything. So, playing by the same rules, and since you can't know what the officers saw, didn't see or immagined without also being in their heads, the officers will simply tell the judge the same thing you will, that that "saw you".
