What is the name of your state (only U.S. law)? CA

This is a 2 scenario question revolving around something actual that happened tragically in Los Angeles the other day. I'm assuming that the Law would be similar in most states for this:

Hit and Run The Driver Lets Say Hypothetically is Sober (Lets not go into the ways of proving this):

You are a passenger in a car and the driver hits someone and doesn't stop. Are you also guilty of hit and run if he didn't stop and you don't report it? If you do report it, are you guilty of hit and run even though you were a passenger? Are you liable for anything else?

Hit and Run The Driver is Driving above the Alcohol Limit and You Are a Passenger

You are a passenger in a car and the driver hits someone and doesn't stop. Are you also guilty of hit and run if he didn't stop and you don't report it? If you do report it, are you guilty of hit and run even though you were a passenger? Are you Are you liable for anything else?
