3rd dui question

But really, his last conviction was greater than 5 yrs ago ... I doubt he'll see jail until after trial. He does not say when his 1st conviction was .. if 10 yrs ago or earlier then he may be in hot doo-doo.

5 months ago I got my second DUI (last one was 6 years ago) for driving under my persciption for xanax. I had .04 in my bac. Just last week I received another one for xanax with no alcohol in my system. I am terrified of what will happen jail wise. I hired a very good DUI attorney. When my arraignment for the second one comes next month will I be sent back to jail with posted bail?

I doubt it for the 2nd offense . Jail is very expensive for the entities involved so the judges/prosecutors much prefer to send you to to community service and other impediments to your freedom for months to years.

However, your latest would be your 3rd DUI within 10 years. Unless you beat the latest charge, you will be facing significant penalties, including jail time.

Depending on the alternatives, jail time may not be the less-attractive alternative. For example, I currently have a DUI for which I have to pay a fine, 30 hours of alcohol classes, AA attendance, a week of hard manual labor. My lawyer did not informed me of these penalties, but I probably would have opted for jail instead.

Before the peanut gallery jumps in - yes, I am a criminal, and I deserve to be punished. But, given the options of a month in jail, or the classes/work-project/AA regiment, I would actually prefer jail.


Having said all that, taking Xanax is not conducive to driving, and from a purely medical point of view,you should see an addiction specialist.

I will follow the tradition of most of the posters on this forum and not reveal my (non-criminal) background, since my advice (like any other on the Internet) should be treated with skepticism. When I make specific comments (the non-sarcastic ones, anyways), it is on the basis of personal experience or occupational expertise.

ty for the replies. Yes I know that I am a complete idiot, but to be honest i prefer the word sick. I guess they go hand in hand. I have been attending meetings and need to get sponsored still. I have a few numbers that I have received and its a comforting enviorment where people don't make comments like on here lol (i understand though). Most of all they do not judge you.
I had been to AA in the past but it was required and I still did not believe that I was an alcoholic, I belived I abused alcohol at times but not always. I'm quite aware without treatment I will end up in jail or dead or will have to live with killing someone in jail etc**************. The thing that sucks for people with addiction is ones that are not do not understand. You really think I enjoy cuffs, no car, scarlet letter,jail, no money??????????????? Then you are right**************.. I am in idiot, who is sick and needs help. BTW I must of posted wrong, My first DUI was 2006, my second was 5 months ago, and the latest was just the other week. The reason I am reaching out is because if I dont could have number DUI # 4 tomorrow or in a year.

wow, DUI on xanax ... how much did you take ? even at 5MG it should not to impair your ablility to drive.
If you were a cop and your computer showed the car in front of you has a dui from 4 months ago and a prior to that, what are you gonna watch for? 5mg is quite a good dose of xanax. Give that to someone who does not take xanax often or never and B.S. it does not impair you. I think it is you who is joking my friend.

QS, your immediate problem is not legal, though those consequences will be huge. You are addicted to and abusing Xanax +/- alcohol. You need to see an addiction counselor or doctor to taper off both. AA by itself is not a great acute treatment

It is not unreasonable for cops to treat you differently in light of your previous DUI's.

We give Xanax to patients all the time. The standard blurp is don't drive (to protect our asses), but of course all of them will drive. Some of them (taking good doses long-term) are impaired,

Look, Proserpina, I am sure you are a very nice person and all, but you post incessantly in every field, on topics of which you have no clue! And give advice like "there is a more-than-decent-chance - blah,blah,blah.) Is there any one on earth who hasn't already come up with your sage wisdom? I hate to pick on you, since there are others here who post with exactly the same crap. But, at 27+ posts a day, can you consider cutting your posts to, say, a mere 20 a day?

Get back to me after you have taken or prescribed Xanax.

Well I am day 5 sober and just fine physically. People have told me that I am very bizarre in the fact that I do not go through much physical distraught, its the psychological part for me**************. Are you saying it in that context? I would always run out of meds early... sometimes weeks... Is there any type of sentencing that would place me in one of these areas?

Chances are that erratic driving is what will lead to a computer check, not vice versa.

And it's not typical to routinely pick up driving histories and/or criminal histories during a routine license or registration check.

I can't help with your legal problems, so I won't comment further. I will reiterate that you should seek addiction help; short-term abstinence means little.

nope. the best treament for sobriety long term is probation with random weekly drug & EtG tests :) best results ever !

failed test = welcome to jail.
