If a domestic special needs adoption falls through, can the Adoption Tax Credit be taken ? The child was in my home almost (4) months and was removed because of the ICWA law.

No, you don't get the special needs adoption credit. However, you can claim a credit for any actual unreimbursed expenses pertaining to an adoption that fell through.
