I need help!!!! Can I proceed with legal actions. I have support docs and questions and requests never answered by them.
As of today we are with NO AC - 18th days now. Below a brief summary.

Please if there is someone out there that could give some good advice and help please come forward.


" Considering the continuing complains ( during the past occasions ) from our side, not properly followed up and, only ending with wrong and unprofessional suggestions on how to repair and fix the multiple issues of the system, we had also communicated our disappointment and extreme discomfort to the Consumer Affairs Lennox Costco and other related organisations ( BBB - Yelp - 7news).

The entire system still under warranty. Installation date was 10/2013 we found all the paperwork and approvals from the city.

What Airpros usa did to us has been unethical, dangerous and illegal considering also that they have used non- Lennox part for a system that should have been replaced since the date when the issues started.


SUMMARY :

We have signed the contract with Solar Bear on October 19th 2013. Our AC system was approved by the City of Pembroke Pines on 4/1/ 2014 (We have support documentation). Airpros USA stated in various occasions ( on 2020/21 and recently '23) that our Lennox unit was out of Warranty and that we had to pay for every part and labor of the units when failing on each and every occasion. (We have support Docs). We did spent $15,674 form the past 3 yrs.

Recent dangerous situations (Faulty wiring, installation of non-Lennox part - Genteq model 5SME39SX L224 (Pictures available) that have been brought to our attention and discovered on April 15th by a Lennox authorize technician from Cool Bear company ( authorized by Lennox and Costco representative ).

Thankfully the visit from a technician from Cooler Bear revealed that our family has been exposed for the 3 years to "a highly dangerous situation of a potential fire hazard " which could have led to a fire in our home. Faulty wiring and installation of non-Lennox part were found to be not as per Lennox technical specifications and electrical related codes. Installing multiple vital parts that are NON-Lennox specifics and not aligned to have the system functioning properly as it should have during the past years.
In addition to the high cost that we have encountered on our FPL bills from 2020 till now.

As you can see Airpros USA have been taking advantage of the situation and putting us in great discomfort since 2020 and we are so furious now more than before.

With the above and support records provided for reference and actions we are confident that Lennox and Costco Industry will properly follow up to best support us on solving this long stressful agony of disrespect, unjust acts, crime and scandal to the community of honest workers and consumers.

In what way(s) do you believe the air conditioning company was negligent? What damages have you suffered as a result of this suspected negligence?

They have continue for the past 3 years to lie to us, taking advantage of the situation and putting us in great discomfort and danger since 2020. In addition all the money that we have paid to them when shouldn't have been spent a $.

Anyone can sue anyone for anything.

If you want to explain what happened in a clear, narrative form, someone might be able to evaluate your likelihood of suing successfully. For example, on January 1, 2019, I bought an air conditioning system from Company X. On January 1, 2020, the system stopped working. On January 2, 2020, I called Company Y for warranty service. Etc., etc. Bald accusations without facts aren't helpful.

A word of warning: Your use of real names in your post here and in online reviews like Yelp can be problematic if you cannot adequately support the truth (or substantial truth) of every accusation you make against the named companies. Defamation is the publication of false statements of fact that causes harm to the reputation of an individual or entity. Reputations are valuable. Damages awarded for defamation can be extremely high, as recent defamation lawsuits in the news nicely illustrate.

You can sue to try to recover the costs of the damages you have suffered as a result of the faulty installation of the air conditioner or use of inadequate parts. You cannot, however, sue to recover for things that could have happened but did not (like a fire).

You can seek out assistance from an attorney in your area if you are unsure how to proceed with a small claims suit or if your claimed damages exceed the small claims limit. It could be important to note that your air conditioner is old - the average life expectancy of an air conditioner in a state like Florida is 10-15 years.
