What is the name of your state (only U.S. law)? california,

I recently had a checking account closed due to money due to an overdrawal. The account is now with a collection agency. Can I go to another bank and open a new
account without my money being taken out to cover the other account in collections.?

You could if another bank is willing to take a chance on you - I highly doubt they will. In your case I would say cash is king.
