The situation goes as follows: A little over a year ago myself and four other college students got together and found a house to rent for two years because of the amount of time we had left in college. A contract was made for this agreement but not all parties could be at the signing of it. Copies were made for the other roommates to be signed but were never signed because of trust and sheer forgetfulness of the original roommates. Everyone involved in this agreement, agreed to live in the house for two years verbally and everyone can attest to this. On the contract, all parties involved were written on the lease but only three of us signed it.
Last week one of those roommates decided she wanted to move in with her boyfriend and would pay the next couple months of rent but after that we would be on our own. This was communicated through text messaging.
Note* One of the people who originally signed the lease asked to move out about 6 months ago and was allowed because found a person to replace her
My question: Would any of this be enforceable in the court of law. The person's name is on the contract but she did not sign the contract. Even though she was FULLY aware of the contract and verbally agreed to all the roommates that she was committed to living at the house for the full two years. Is there anyway to force this roommate to pay out the full terms of the contract?
