What is the name of your state? Michigan

Can my husband refinance our home, put the loan strictly under his name, take out equity to pay off part his debt (my name is not on his debt) if I am about to file chapter 7 ?

What should be done first the refi or that chapter 7 filing?? :rolleyes:

Something tells me you've not talked with an attorney.
Make no property transfer prior to filing without your lawyers OK. It's not enough to refi in his name. You'd have to sign a quitclaim deed and that would be a property transfer.

Our mortgage lender claims he can refi with out me on the loan, and I do not have to sign a quit claim deed???

I will contact an attorney to find out . Thanks.
