City Water has sent "intent to Discontinue Service" for Complex

:eek: November 24th and January 26th the tenants in our complex have recieved notices on our door from the CITY WATER "Intent to disconnect Service for 43 units" :eek:

We pay a set amount to water monthly to a service thru the complex. Are they in breach of Lease? We are scared to pay our rent and be thrown on the streets with no money to go elsewhere. We have refused to pay them rent this month (January) till we get notification that it has been paid. Landlords response...you will incur late fees. We refuse to pay late fees when it is settled. Today we received a 5 day notice "intent for terminate lease".

What is the law on this. Especially because it has happened twice now?:confused:

You are in violation of your lease. You can't arbitrarily withhold rent. Your water has NOT been shut off.

Yea, you better pay them, and the late fee's, you can be out on the streets with no money to move if you are evicted for non payment. and have a judgement placed on you and your name for a looong while.






Plus. if the LL has to file the suit, then that can be brought up on a search of your name and rental history when you need a new place.

Look. you need a court order to withhold rent.


Pay your rent. When the water is turned off call the town for inspection, and bring your landlord to court if he doesnt fix it.



Pay your rent or you are likely to be evicted.

The landlord cannot necessarily disconnect your water for non payment, but the city sure can for LL non payment. Look over your lease, I bet it has a clause somewhere about LL responsiblity to maintain water and sewer and hopefully a clause for immediate termination of your lease with X days notice and if uncorrected, not to mention the LL may forfeit all right to legal recourse against you.
