What is the name of your state (only U.S. law)? Wisconsin
I met my fiance (who is 20) last year after she started to apply for SSI for basically being incapable of working because of severe mental issues and being extremely dependent on her mom. Problem is, she's fully capable of working, but her mom pressured her into going through the process and had her fake a psychological illness. I talked her into dropping it when it was denied because I didn't like the legal endangerment of fraud and possible issues that could come up in the future with getting married and having kids if they thought she was incapable of responsibly getting married and, especially, having a baby. As such, she told her mom not to appeal it. Her mom agreed to this, but then appealed it behind her back. We became suspicious of this and called the SSA toll-free number and found out that her case had been appealed and she was now actually receiving payments and had been for 2 months. Now, they've frozen her account and the case and her mom is being investigated. We live across the country from her mom, but the case is in Wisconsin (moved to our new state 2 months ago and we don't want to have to move back because of these issues). We're afraid of her mom going to jail for this, but at the same time are in quite a situation because my wife is supposed to be incapable of living without her mom. We've thought that we could have her mom tell them that she found a man with "the patience of a saint" (to use the words of her mom soon after she first met me) who understands her and loves her despite her disability and is willing to take care of her, completely aware of her "problems." Her mom is obsessed with keeping the SSI, but I quite frankly don't care about it. I don't currently have an income, but am looking for employment and (for 3 1/2 years) was making over $50,000 as a machine operator up until a year ago and I know I can support us just fine without assistance from the government. The main thing I need is advice to get out of this situation without any legal problems. I don't want my fiance's mom to end up in jail over this, even though she was in the wrong not only to file this fraudulently, but also to continue it behind my fiance's back. She only did it because she loves her daughter and wanted to make sure she had money to live comfortably, and I just want to keep her out of jail, regardless of whether my fiance loses the ssi... like I said, that doesn't matter to me, and I'd honestly prefer to not have to deal with all the government bs that comes with it. Thanks a whole lot in advance for your advice on this... I really appreciate it!
