What is the name of your state (only U.S. law)? California
My husband is a General Contractor and owns his own business. His main truck that he uses every day was hit and in the shop for 7 of his working days. We are asking the insurance company of the person who hit us, to compensate him for his loss of use of his truck.. and the insurance company is asking for tax returns.. and a laundry list of BS to verify his wages.. saying they will not pay this. What is the law on this? His average is $500 a day, so 7 days without his vehicle...
And the *rental car* replacement doesn't work in this matter.. he needs his lumber rack, tool boxes.. etc, all the items a contractor needs for their job ! Any suggestions?

If he wants the money, he'll need to prove the loss.

"Work trucks" can be rented...what did he do to mitigate the damages?

Why did he not trot down to a major local hardware chain and rent another truck? He failed to mitigate his damages. That is assuming he could of course prove he lost money to begin with.

He would need to prove that he had work lined up that he had to cancel, or offers that he turned down. Concrete proof of loss of money. Not just POTENTIAL loss of income.
