Just to close this up. He took his plea bargain today. No jail time. 5 years supervised probation. Lifetime registration as a sex offender and a heafty set of fines and classes to pay for.

Djs: Just to touch on the information that you received from your Ex; it's going to be his word against the officers that he was tricked into giving up any information. I know the case has been heard and settled, but I'm not sure if you or he would feel the need to follow up this other point.

He was admittedly drunk, and thus his recollection of the statements he made and the events surrounding such would be called into question. The officers will say that his rights were read to him and that he acknowledged his understanding of those rights. He also gave statements without an attorney there, and again, he'd have to prove that his rights weren't read before he was asked any questions.

Also, there are some specific rules concerning when an officer must read a suspect their rights. While they ensure that a suspect will be made aware of their rights if arrested, they don't tie the hands of the officers when conducting an investigation.

Anyway, proving that your Ex was duped and not made aware of or afforded his rights would be extremely difficult to do at this point.
