Hi, I have a couple of questions but first I will tell you the history of this case. The parents were not married and lived in different locations. The two boys are currently residing with the maternal grandparents. The mother has abandoned them and left the children tormented due to exposing them to sexual content at an early age. Still to be determined if the boys were abused. The grandparents are taking the father to court next month for more child support. He already pays 20% of his income but they are asking for more. He doesn't have more to give and if he does then he will be forced to leave his residence b/c he will not be able to afford it. He spent much time trying to find a lawyer (that he could afford) but he was told there was nothing they could do.. that he would have to pay. He WANTS custody but he can't prove the situation with the mother and the court keeps allowing her to have custody saying that he is not financial capable of it but yet they seem to think he has enough to keep paying more in child support. He's been going through this since 2000. I want him to be prepared for court in Feb. but not sure how to approach it. So here are the questions:
1. First off.. he needs to know his rights.. so if anyone can direct me to a resource for Texas or if you have information.. please let me know.
2. Can the court take more money from him when the mother isn't even paying child support herself?.. how can we prove that? or can we?
3. I initially had more questions before I started this but now I'm drawing a blank So if you have any advice for how we can prepare him for court or on his rights ... PLEASE let us know. Thank you so much for your help.
Also, here in the county that the court case will take place.. sadly, they do it much like traffic court, filled with many other cases and your time allotted for your case is minimal. Also, the counselor that the children see are the ones that informed the family of abuse in care of the mother.. is there a way to get that info for court or will it not be submissable?
