My daughter was charged and pled guilty to a shop lifting charge when she was 17 years old. She paid the fine and restitution and court cost. She was told at that time if she did her records would be sealed. The judge did sign the order to seal her records but the clerk fail to enter the information.
Now she has a job as a teacher and the back ground check showed this arrest (Which the court should have sealed - the clerk said it was their mistake and she would send a letter to the proper authority to have it sealed). In the mean time the school board has sent my daughter a letter asking why she did not disclose the arrest.
Should we answer back and say we don't know what they are talking about and ask them to run another report (THE COURT CLERK SAYS SHE WILL CALL US BACK ONCE THE RECORD IS SEALED) or should she tell the board that this happen when she was under the age of 17 and the court records were supposed to be sealed. WHAT SHOULD WE DO SHE COULD LOSE HER JOB OR BE DENIED HER TEACHING CERTICATED.
DO WE NEED A LAWYER FOR THIS HOW SHOULD WE RESOND TO THE SCHOOL BOARD?
