My friend D has a brother who has sole custody of his 15 year old son (M) but actually his sister (D) has raised M for 12 1/2 years with no support from either parent. D is the director of the United Way here in town and has provided M with a happy, secure home. Tonight M's father went to D's house and took M away to live with him, calling the police when M stated that he did not want to go with his father. M told the police he wants to stay with D, where his friends, school, etc. are. After 3 hrs. of this the police told M he would have to go with his dad or go to the juvenile detention center. M went with his dad. His step-mother will not allow M to receive calls currently.
M's mother is on the way here to stay with D, and has never really enforced visitation, which she has a right to.
Obviolusly M's father has a legal right to do this. What would be the best way to get this before a judge asap so M can tell the judge his preference, also to tell the judge that his step-mother hits him?
Can the mother stay with D and ask for visitation there?
What are the first steps for the mother to challenge current custody, on an urgent basis?
Is the rumor that at a certain age a minor can choose which parent/relative to live with true?
