death of child - who pays for what?

What is the name of your state? Wisconsin

My 7 year old son recently passed, and after several attempts to communicate with his bilogical father, I haven't heard anything regarding the final expenses. Is this an issue that I would take back to family court before the case is closed, or would I have to take him to small claims court? Thanks!

Is biological father the legal father? YOu say there is a family court case but what kind of case -- divorce/paternity/child support?

Biological father is the legal father, and the court case is a paternity case.

Technically you would probably each be made to pay for half or whatever percentage of support was involved. In other words if you were responsible for 40% of support and him 60% that is most likely what a court would reward if you took him to family court for the funeral costs.

Fair would be 50% and easy to obtain in small claims as well. The sad thing is you even have to fight this out.
