When I trained ajudicators in unemployment law, there was much emphasis on "due diligence" and whether you had been trained, and whether you were fulfilling your obligations to your employer. Misconduct is misbehavior where you have been trained, you know better, you have the capability to do it right, and by your choice, you have done it wrong. If you were "goofing off" or doing something stupid enough that it was not in the best interest of your employer, and you knew this, then that is misconduct. Malice, a desire to hurt your employer, intent to do it, gets into major misconduct.

Chances? Who can say? It's a toss up. But when you present your case, this will be your defense, that you messed up, but it wasn't intentional. About the only defense you have here. Are you out of work through no fault of your own?
