You will need to request a full accounting of your employment history for 2007 from the first employer. Chances are they will notice this payroll deposit and reverse it also. Have you contacted their HR/Payroll department? I would suggest your communications be in writing to prove that you are trying to rectify this.

Your legal recourse for nonpayment of wages/accrued vacation is the DLSE. You may not legally resort to "self-help" by keeping money you know you didn't earn. Why don't you just write them a check for the net amount of the extra direct deposit and send it certified, return receipt requested. Then file the claim for unpaid wage/vacation, if any, with the DLSE.

They've already taken money out 10 days later. What are the chances they'll realize what they did and reverse the deposit again?

I probably would write to these folks IMMEDIATELY and ask them which method they would prefer. The reversal is cleaner from an accounting perspective, but either way works.
