What is the name of your state? TX

On the discovery it asks for all emails and photos relevant to the character and property of the divorce case.

What's the general thinking about what to include? There are tons of emails, but anything I sent to my spouse or he sent to me, he already has, so why should I have to produce it. Same with photos?

Thanks for your reply, Zephr! What if the emails contain highly sexual content? And if the photos contain full and explicit nudity of my spouse and sexual acts?

What will happen to those photos and emails when they go to the lawyer? Could they end up being put as publicly available evidence?

regardless if you do not provide what they KNOW you have in your possession or have access to and they have to ask the judge to order you to provide them...then you're gonna tick off the judge

They are photos of both of us. I will tell you the more embarrasing ones are of my soon to be ex.

They are digital photos and my stbx has them as well on the his computer, so I don't understand why I have to produce them. Why wouldn't the judge be ticked off that he doesn't produce them if he has them? But I still don't see why anyone needs this sort of material, unless they all want to get a kick out of porn. But nowadays, free amateur porn is all over the web, so they shouldn't need ours.

did you officially ask them to produce the photos?

a lot of times lawyers use the idea that something that is potentially embarrassing (such as this) may be brought up in a round about way of encouraging a settlement...kinda like legal extortion/blackmail

Ok, look...you have to provide them if they are RELEVANT to the case. If not, you can object to them as being not relevant to the case... there are also other objections you can make.

However, you can still be compelled by the court to provide the requested information if the court doesn't agree with your objection.
