It is NOT a condominium. At best it is a duplex.
Do a search of 'condex' on the internet. You will find that they are:
- a condom

and yes, even a few references to 'condex property's'. However, those all seem to be 'local terms', but are NOT legal descriptions.

In any case, you will quickly learn that you have NO control over what your co-property (condex, condo, duplex, whatever you call it) owner can do with HIS property. No more so than he has over you. In fact, from your own post, your co-owner has more 'voting power' (51% to 49%) than you do, so any action you try to take may be met with a 'no parking on premises' ban against you..... or worse.
In any case, do whatever you want. Simply, I have no dog in your fight.

And since you have absolutely no legal right to ban smoking on 'common areas' and unless the other occupants are harrassing you and you can prove it, or unless they are committing crimes that you can PROVE, you will NOT get a tro.

And since Cambridge has no smoking ban for outside areas, what else do you expect? You came here looking for someone to agree that you have a legal course of action and found one idiot to agree with you.

Guess what? Following her advice will not only cost you unnecessary expenses, it will also result in absolutely no action.
