I obviously don't work for BBB. You asked for opinions and I gave mine. I still think you made a mountain out of a molehill. If she was snotty to you, you certainly were free to speak to someone in HR or more senior management. Making a "federal case" out of something as minor as this doesn't do you any good at all.

By the way even if you are an adult in a 8 hour work day you are entitled to half an hour lunch, plus two breaks, wether you take them or not is up to the individual. No, you're not. This is direct from NJ's DOL website: BREAK PERIODS

Q. Am I required to give employees breaks or lunches?

A. The mandatory break law only applies to minors under the age of 18. Minors must be given a thirty (30) minute meal period after five (5) consecutive hours of work. Company policy dictates break and lunch periods for anyone over the age of 18.

Before you start spouting off about employee rights, you should take the time to find out what the law requires.
I was just going by what a paper that was posted in our breakroom stated that was taken down and hidden and yet to return once i drew attention to it. Thats all.

I don't know how educated I am, but I'm not stupid enough to get fired over nothing. Enjoy living on the street.
Yes I asked for advice. Those of you that have replied have made me feel small, insignificant, and that my life and problem wether small or large doesnt matter. I already started to look for another job. But because of people like you big corporations step on the little guy and keep going. This country was founded by people who had a problem with people who had more power then they did and looked what happened.

maybe I should have titled it differently then whistleblowing, is it wrongful termination.
Your employer did not do anything illegal. It doesn't matter what you title your post.

Company policy and the law are two different things entirely. Since the law does not require breaks be provided to adults, BBB is under no obligation to offer them or post company policy regarding breaks.

seanmichael, you ascerted that your employer acted illegally in a number of regards. We all told you they did not and why. Then you argued with everyone. Time to grow up and start acting like an adult, even when the information you're seeking is not what you want to hear.

O.k. I can understand from a legal stand point. What about principle, so are you saying it's ok for someone to sue McDonalds and win, when they spilled a beverage on themselves knowing it was hot. Apperently I would have to fall and or injure myself to have a legitmate complaint. Talking about laying your life on the line.

If all you're going to do is insult the people who are giving you the legally correct answer to your questions, why don't you just save everyone a lot of time and trouble?

Please generate the answer you want.

Dear (your user name)

Thank you for submitting your (question) (rant) (spam) (porn) regarding (your friend) (your ex) (your SO’s ex) (your boss) (your landlord) (the police) (Paris Hilton).

It is our unanimous opinion that you are (right) (damn right) and it should be obvious to any moron that your (ex) (SO’s ex) (boss) (landlord) (local police) should be immediately (jailed) (fired) (reprimanded) (arrested) (demoted) (shot) (evicted).

In fact, you are so astonishingly correct in this matter, it will not surprise us one bit if you are (offered a generous settlement) (given custody) (promoted) (released ROR) (declared step-parent of the year) (given everything while s/he is cast aside to suffer in squalor and shame because, by golly, that’s just how it should be.)

Please proceed immediately with your proposed plan of action, which we think is (a good idea) (a really good idea) (sheer genius) (a lot better than what any licensed attorney could come up with.)

You rock.

Love,

Us

That is a great statement. This country and world has gone through a great many changes by everday people who stood up for what they believed in. This was the best advice I could have ever recieved. I thank you, my family thanks you, with this you make life worth living. and here I was going to committ suicide. By the way most of you deserve to be at the bottom of the ocean, who's first?

Your right its not whats about right or wrong, or wether they did anything legally or illegally. What it boils down to there is no money in it for you. Heaven forbid I make a federal case and not get paid. Trust me I spoke with the family attorney I allready know the answers. I just wanted to get opinions. Which still goes to prove what money grubbing self indulgent, selfish, sh-tbags you really are.

OP you are absolutely amazing. You're comments are the most childish I've come across on this board. You were NOT wrongfully terminated based on your gender under the law. You're arguing the principle of the matter when in a court of law it doesn't matter. EVEN IF you believed you were called out because of your gender, you still had an obligation to show up to work the next regardless if you were being alienated by your co-workers, not feeling like you belonged, etc. An employer does not need to resolve petty matters like this in a 24 hr time frame to please YOU and make YOU happy. Regardless of WHY you didn't show up to work, bottom line is you didn't. Just cause for termination. All this he said / she said business will get you no where with your complaint. Trust the advice given on this board. It is real

You couldn't be those people. All these folks you describe are professional and respectful of others and don't resort to acting like a world class jerk. I would rather rot in heaven than where you will be going.
What planet do you live on. Hi welcome to earth have we met? Yes your right those people act professional and are courtious, because they are down to earth blue collar workers(thanks for proving my point). Look at the guy that represents the state of New York caught in a prostitution ring. Our own House of Representatives house members with multple DUI convictions and never served a bit of time. These are supposed to be leaders and role models. As far as were I am going I dont care were it is so long as its not around you.

yada yada yada.

after all that nastiness coming out of your mouth, you still don't have a wrongful termination case. end of story. instead of waiting for incoming responses to your post, go out and look for a job! BBB is NOT going to hire you back or pay you a damned penny. You do have a family to support right? stop wasting time! go WORK!

The complaint was It was a discriminating comment against my gender.
No it wasn't, it was a discriminating comment against the female gender. And only the ones discriminated against (in this case, females) have the legal right to make illegal discrimination complaints. If you were female making this complaint, and you were subsequently fired, it might appear to be illegal retaliation. However, your three-days-no-call-no-show would certainly cloud the issue.

Given that you're not female, the only valid reason you were fired was your three-days-no-call-no-show. And that's a perfectly legal reason.

...but as usual you werent there. So maybe your advice should be kept to yourself
Surely you were aware at the time of your original post that NONE of us were "there"...and yet you asked us for advice anyway? But didn't want us to provide any advice because we weren't "there"...huh?

Ironically enough I never once said I wanted a penny or my job back. Everyone here was so quick to judge. I had fun toying with you these past few hours

It's obvious you haven't realized that many many employers (possibly including BBB) trawl the internet looking for posts about their organizations by their employees/ex-employees. If BBB is a typical employer and does this, you can bet that BBB is going to tell all of your future prospective employers who call BBB for references about you all about your childish, irresponsible, defamatory and obscene posts here on freeadvice.com. (And before you ask, yes, it would be perfectly legal for BBB to do this.) You can also bet that none of those future prospective employers will hire you.
