I manage a condo and have one maintenance worker. The Employment Agreement is "at will". He was about to be fired but he suddenly injured his shoulder on the job and has been out of work for eight weeks. He was back for light duty but complained of pain after two hours and left. Now it seems the doctor has indicated a need for surgery (I have my doubts about the severity of the injury) and has restricted the employee to total inactivity! My WC rep is mostly useless and I am without a worker for who knows how long.
Given that there is a documented history of problems prior to the injury, can I fire the guy without legal repercussions?
