This isn't a hypothetical question LOL but a question based on fact. Apparently in the recent murder of the Florida couple with 18 (?) kids, the police have already arrested I think 7 people and have learned that someone not amongst the 7 was supposed to disable the security system that took pictures of the whole thing. For whatever reason that person never showed up. If someone backs out of a planned murder or crime and doesn't participate in the actual crime, are they still guilty of murder or conspiracy of the crime or a they "innocent" in terms of the law? If they will be charged by the law anyway, how exactly can someone legally back off from a planned crime that hasn't happened yet?

In a bonus question that probably won't get answered because people here don't think its the purpose of this forum even though the Forum itself doesn't state that, on "24" a hitman was contacted to kill someone with the instruction he would not do so until money was wired in the bank. The money was not wired in the bank and the woman tried to tell the hitman that she decided not to go ahead. For some reason the Hitman did anyway. Is she still guilty of murder or conspiracy even though she technically canceled the crime?

A: This is a hypothetical question and I don't have enough facts to even guess. However, it depends on how planning the person did before he backs out. That's just one of many different facts to be taken into account.
