House damage from dogs

We entered into A purchase agreement contract 18 months ago. Long story short the buyers could not secure financing and when the final extension was up they not only refused to pay rent but refused to vacate after proper notice was given. We went to court and won and judge gave them 10 days to vacate. They moved on 10th day and we went to house with our agent for a walk thru, agent handled ecerything for us in regards to contract. When we entered the home we were in shock to discover the amount of damage to house, its 2300 sq feet with 2 car garage. Every inch was damaged by digs, we agreed to one dog but found out thru neighbors they were breeding pitbulls! The garage was destroyed, feces everywhere, dogs chewed thru the garage out the exterior and several areas outside of home the siding was clawed and chewed thru, the lawn was beautifil with flower garden and all destroyed, this was our home prior to moving, lived there 15 years! The wood swingset we put in conveyed and was 3 yrs old bought for grandkids, destroyed. Holes everywhere and fence destroed. Inside was like a kennel, doors, trim baseboards drywall all destroyed from dogs. Fixtures all broke from who knows what. We are not landlords, we were selling this home to them and they absolutely destoyed it. Any advice? We took pictures but have no clue where they went to file a suit for damages. The clerks office said we are out of luck if we cant provide address to sue. We know where the guy wirks but thats it. And can we sue for all damages?

Virginia allows lawsuits up to $5000 to be heard in Small Claims court. It sounds as if your damages exceed this amount. Thus, it is suggested that you consider making an appointment with an attorney to discuss your options regarding a lawsuit against these folks.

The Contract was a Lease Purchase aagreement for 1 year. They paid rent with $200 to be credited back at closing, they paid a security deposit to us and another deposit to realtor to be held in escrow till closing. We gave an extension with an addendum signed by both parties to them once but we had issues the last 3 months with them paying rent. They owe us back rent, late fees and damages. The judge awarded us Back rent and late fees plus court costs and interest which they havent paid. Went to court May 9th for that and judge ordered them out 10 days because they would not vacate with our written request. They got out May 23 so can we get any Money for May? Or they just live free for those 23 days? The contract stated if closing did not occur or they moved the house was to be in same condition when the took possession minus normal wear and tear.

Little reality ajustment:

You have bigger problems than your May rent. It does not really matter, how much you get awarded from a judge (and sure, there is room for more), you will have to collect it. And it looks like these people have no money, so there will be little to collect.

Don't count on a single penny from them.
