Joint will binding contract?

What is the name of your state? TX

My dad and step-mother did joint wills stating that everything goes to the other and then to the children following the last spouses death.

This is ideal for a couple who have children together, but unfortunately my dad died leaving my step-mother everything. Her will, of course, states everything goes to me and my brother upon her death.

Since these were done before my dad's death, can we consider her will at the time of his death a legally binding contract?
