We have no factual information from our writer that Ca Penal Code section 192.5a has any applicability to the case; i.e., we have no information that the reason they were on the boat was for the purpose of ". . . the commission of an unlawful act."
All we have is that "the boat capsized and the multiple anchor chains that were on the deck of the boat entangled the guest and the guest drowned."
For all we know, they were on a pleasure cruise, and not the commission of a crime, and THEN someone was killed. Our writer makes it out to be an "accident", but gives no information about "why" the detective is charging the friend with the guests' death.
