What is the name of your state (only U.S. law)? NC, IL
My boyfriend has 3 children 18, 16 and 13. He currently pays child support for the 13 yr old and sees him regularly. The 18 and 16 yr old recently moved in with us, from chicago because their mother moved to another state, so they had nowhere else to go. He is currently speaking with a lawyer, in order to change the custody, for the 2 older children in Illinois. He is behind on child support in IL, and what he pays for the 13 yr old(here in NC), is the obligation plus arrears. So he is current in NC. Can he still get a modification for the 13 yr old since both the 18 and 16 year old lives with us, although custody has not complete? This has, of course, been a transition because of essentially how much it costs for teenagers.
With the mother of the 2 oldest essentially abandoning them, we had to make moves quickly because of the urgency. Their mother is not in this country legally, but both children were born in the US. She essentially moved to either CA or Utah, but we are not sure. Their divorce/custody was done in IL. we are currently looking for a lawyer in IL, to assist us but he is indeed behind in CS, but we can't seem to find anything online to tell us what he owes or even if its in the system. We have no help financially, at least for now, until we can find a lawyer in IL. Being in NC makes this difficult but trying to do as much via phone as possible.
Although he doesnt have custody of the older children, at this time, yet they live with us and we support them financially, is that enough to modify the NC agreement?
